Unrepresented Buyers
Never send a Docusign for anything to an unrepresented buyer or seller. You can print out the document and hand it to them or send it to them as a pdf and they can print and sign and get it back to you.
When we send someone a Docusign it is implying representation. We can not do that.
We can not give ANY guidance to them. If they are unrepresented then they must do it on their own.
If they have questions then we can tell them to check in the contract. We can give them line numbers and sections but not information.
BINSR: Have them email you what they want. You may fill it out and then send it to them as a pdf to print and sign.
People choose to go unrepresented because they don’t know what they don’t know. They think that they are going to save money by not using an agent. That is Typically not the case.
We MUST have the conversation with your Seller about Agency at the Beginning. Are they ok with it? How would they like it handled?
If you want to ask if the buyer is going to do something we must ask our seller if they want you to and get it in writing that they want you to.
For example: If the 10 day inspection period is coming to an end and the buyer has not said anything about the BINSR then it is up to your sellers if they want you to ask the buyers about it and remind them. If they do not then you can not ask them, it is in the contract and if they did not read it then that is on them.
We must have the unrepresented buyer sign an Agency Document acknowledging that you ONLY represent the seller and you do not represent them at all.
Limited Dual Representation
Always ask the question at the Listing appointment if they are open to this type of Representation. Are they willing to do Limited Dual.
Make sure that they FULLY understand what it really means.
It is LIMITED representation! You are now in the middle and have to represent Both sides Equally.
Both sides must sign Agency Before they sign Dual Agency.
Must list as a Variable commission in the MLS if you are giving a discount if you rep both sides.
You can’t have a discussion with the buyer about what the seller will accept. You can not give anything away.
Can not give them comps either. You can only give them what has Sold!
Can’t disclose details about past offers. Only that they exist but not any details about them.
Explain the contract, dates, etc, then ask for instructions from them.
You MUST maintain a middle position between the Buyer & Seller.
